The Personal Best brand as well as the website https://www.personalbest.si (hereinafter “website”, “our website”) are the properties of the company PERSONAL BEST, sales and distribution Ltd.
1. GENERAL
You enter into this agreement with PERSONAL BEST, sales and distribution Ltd. (hereinafter referred to “Personal Best”, “we”,“us” or “our”). Our website offers a variety of sport equipment products for sale and shipping directly by us.
The Terms of use (hereinafter “Terms”) are drawn up in accordance with regulations in force in the field of electronic commerce and other applicable regulations and apply whenever you visit our websites, interact with us (e.g. customer support conversations, warranty issues etc.) and when purchasing goods from said websites (collectively, the "Services"). These terms of use also apply where we act as a Data Controller. For purposes of this document, "you" and "your", “the client”, “the customer” means you as the user of the Services, whether you are a customer, website visitor, or another individual whose information we have collected. In addition to Terms please review the Privacy Policy (hereinafter: "Privacy Policy"), which governs your submission of personal information through our website and applies as a part of the Terms.
We may change these Terms at any time by posting the revised terms on this page. Any revised terms will automatically be in force on the date specified in the Terms unless otherwise stated. We ensure that these Terms remain up to date and revise them regularly. So it’s important that you check them before every time you use our Services.
You agree that from time to time we may remove the Services for indefinite periods of time or cancel the Services at any time, without notice to you.
To purchase good from us, you must fulfil the following requirements:
- Your age must be at least 18 years old;
- Have a valid debit/credit card that we accept issued in your name;
- To have your delivery address in Ljubljana, Slovenia only.
By using our website, each user:
- explicitly agrees to the Terms as well as Privacy Policy;;
- undertakes to use our website in a lawful manner;
- undertakes not to use the service for the purpose of publishing or distributing any content and/or advertising contrary to applicable law, public order and morality;
- is responsible for knowing and complying with the applicable regulations of the Republic of Slovenia regarding the use of the website,
- agrees not to use the service for commercial, illegal or any other purposes other than those specified in these terms;
- will not distribute copyrighted content or content belonging to another legal or natural person;
- will not attempt to obtain, collect and/or store personal data of other users;
- will not copy, store or transmit in any way all or part of the content of the website; will not use computer codes, malware or anything that may disrupt, disable or damage this service, the service provider or its software and hardware, the path provider and telecommunication devices.
2. PRICES
All prices on the site https://www.personalbest.si are in EUR and include value added tax (VAT) 22% and do not include shipping costs.
All prices may be revised upwards or downwards during the year without prior notice. The price in effect is the price at the time the order is placed and validated. The sales contract between you and us is concluded the moment we confirm the order and you receive an email about the status of the order. From this moment, all prices and other conditions are fixed and apply to both the provider (us) and the buyer (you).
For all orders, a contribution to the shipping costs will be requested. These charges may vary depending on the weight of the order and its destination.
3. ORDER
PURCHASE STEPS:
Items can be ordered as a registered or unregistered user 24 hours a day, every day of the week. When you decide to buy an item and select its option if possible, add it to your shopping cart by clicking on the "Add to bag" button. You can add as many items as you want to your cart, as well as remove them whenever you want. When your cart contains the selected items, click on the "Checkout" button.
STEP: CART OVERVIEW
In the first step, you will see a cart overview. Here you can also remove products or change their quantity. If you want to empty the cart, click on the "Trash can" symbol button. However, if you are interested in any other product , you can return to the store by clicking on the "Continue shopping" button. If you are confident in the purchase of items, click on the "Proceed to checkout" button.
STEP: CHOOSE YOUR PAYMENT AND DELIVERY METHOD
At this step, you choose the payment and delivery methods.
STEP: PAYMENT
In this step, you have an overview of your entire order with all your purchase information. To continue, you must confirm that you agree with the General Terms and Conditions, which can be read by clicking on the link. After reviewing the order for the final placing of the order, click on the button "Pay now" and after the payment is completed successfully you have completed your purchase. After placing your order, you will receive a confirmation email with all the details of the placed order.
STEP: ORDER PLACED
This step shows all the details about your purchase, which you can print if necessary.
Orders may be cancelled in particular depending on our stock or in the event of disputes over a previous payment by a customer.
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgement, appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

4. PAYMENT
In order to ensure the security of payments, the PERSONAL BEST ltd. uses the secure payment service offered by the chosen organisation. This service integrates the SSL security standard. Confidential data (the 16-digit bank card number, the expiration date and the cryptogram) are directly transmitted encrypted without passing through PERSONAL BEST's servers.
The online provision of the bank card number and the final validation of the order will constitute proof of the entirety of the said order and will constitute payment for the sums incurred by entering the items appearing on the order form. This validation constitutes signature and express acceptance of all operations carried out on the site.
5. DELIVERY
Delivery services: only courier service is available; only in Ljubljana, Slovenia.
The cost of delivery in Ljubljana Amounts to 10 euros; for orders over 100 euros delivery is free.
The website indicates the availability of products, those not available cannot be ordered. However, this information must be considered purely indicative and cannot engage our liability.
In the event of a stock error we will inform you as soon as possible. We undertake to do everything possible to respect delivery times, in all cases, to make delivery within a maximum period of 60 (sixty) days from the day after the day of transmission of the order.
Products ordered by you will be sent by courier. The location and time of delivery will be agreed upon in advance by calling you from the company’s delivery service.
Upon receipt of the ordered goods from the courier, you undertake to check that the delivery package includes all ordered goods and to inform the courier if the goods/goods do not correspond to what you ordered. If the product/products are delivered to you not in full accordance with the order or with visible damage, you are asked to refuse the product or accept it “subject to reservation”.
6. RETURN & REFUND
The customer has a withdrawal period of 14 days from the date of receipt of the package to inform us by email at support@personalbest.si of your desire to withdraw. The customer must download and complete the return form located at the bottom of the website in the Terms & Conditions sector and attach it in the return package so that your request can be validated. The product(s) must be returned to us in their original packaging and without having been used. Return costs are the responsibility of the customer.
In the event of a refund, the customer may be reimbursed directly to the card used for payment, by transfer to their account.
In the event of an exchange, for whatever reason (wrong size, order error, etc.), we undertake to return the desired product, at no additional cost, as quickly as possible.
Some items may not be eligible for return or exchange due to hygiene or safety reasons.
Products that cannot be returned and/or exchanged, regardless of whether they are unused, are:
- Swimwear,swimsuits;
- Underwear;
- Food and drinks;
- Products that are made at the request of the user and are clearly personalised according to his wishes.
7. SIZE and CARE Instructions, WARRANTY
All information regarding size and materials can be found on the selected product page.
All products for sale on our website under the MAKO brand are guaranteed for 2 years upon receipt of the product against any manufacturing defect or hidden defects.
This warranty is applicable in the case of normal use, respecting the instructions for maintenance and use marked on the labels or documentation supplied with the product.
For the warranty to be applicable, the buyer must report any defects or improper handling within 1 (one) month of their discovery. The consumer must send an email to support@personalbest.si specifying their order number and date as well as the problem encountered accompanied by a photo.
After your request to recognize the case as a warranty, the support service will contact you to help arrange delivery of the goods to our warehouse, and after receiving the goods we will transfer them to MAKO (Horizon Sport Creation, 4 Rue du Bocage, 35520 La Chapelle des Fougeretz) to validate whether or not the product is covered under warranty. After the MAKO response, we will contact you to coordinate further actions. The time frame for considering the issue of recognizing a case as a warranty case is determined in accordance with applicable law.
8. COPYRIGHT
The manager of the website is the company Personal Best Ltd., which is also the owner of the website. All rights reserved. The website may also contain content (e.g. photos, videos, etc.) for which third parties have copyright. If you want this information or to forward materials from the website to third parties, it is mandatory to obtain the prior consent of the owner. We reserve the right to change the content and terms without prior notice. We reserve the right to make errors, incorrect publications and entries on the website. Upon discovery, we will try to eliminate them as soon as possible.

Certain content, products and Services available via our website may include materials from third-parties.
Third-party links on our website may direct you to third-party websites that are not affiliated with us. We are not liable for any harm or damages related to the purchase or use of goods, Services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.
10. DISPUTE
We comply with applicable consumer protection legislation. We make every effort to fulfil our duty to establish an effective complaint handling system. The complaint is submitted via e-mail address or in writing to our address, which is visible on our website. We are aware that an essential feature of a consumer dispute, at least as far as judicial resolution is concerned, is its disproportion between the economic value of the claim and the costs incurred in resolving the dispute itself. This is also the main obstacle for the buyer/consumer not to initiate a dispute before the court. Therefore, we make every effort to resolve any disputes amicably. Any dispute that cannot be resolved amicably will be submitted to the courts of Ljubljana, Slovenia.
Reminder: The MAKO brand is a registered trademark, any use of the name or logo without authorization from us and/or from MACO is prohibited.
11. OUT OF COURT RESOLUTION OF DISPUTES:
In accordance with legal norms, PERSONAL BEST ltd. does not recognize any provider of out-of-court resolution of consumer disputes as competent for the resolution of a consumer dispute that the consumer could initiate in accordance with the Act on out-of-court resolution of consumer disputes.
12. SEVERABILITY
In the event that any provision of these Terms is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms, such determination shall not affect the validity and enforceability of any other remaining provisions.
13. TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms are effective unless and until terminated by either you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgement you fail, or we suspect that you have failed, to comply with any term or provision of these Terms, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
